TERMS AND CONDITIONS FOR AICHI APPLICATIONS

Please read these Terms and Conditions ("Terms", "Agreement") carefully before purchasing, activating, or using the AICHI application ("Service") operated by [AICHI].

By purchasing, activating, or using the Service, you (User) agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the Service.

1. THE SERVICE (AICHI)

AICHI is an AI-powered Chibi assistant designed to act as a work companion and real-time aid. When streaming mode is activated by the User, AICHI can observe and analyze the User's laptop screen content ("Screen Data") in a streaming mode to provide proactive assistance, insights, and responses to direct queries. AICHI's primary function is to interpret context from Screen Data and provide immediate relevant support.

2. ACCEPTANCE OF TERMS

By accessing and using the Service, you represent that you have read, understood, and agree to be bound by these Terms, and acknowledge that you are at least 18 years old.

3. USER RESPONSIBILITIES & ACKNOWLEDGEMENT OF RISKS

3.1. Screen Data & Privacy (CRITICAL)

  • Voluntary Activation & Consent: You explicitly understand and agree that by activating AICHI's streaming mode, you are voluntarily granting the Service the ability to observe and process the content displayed on your laptop screen in real-time.
  • Sole Accountability for Shared Content: You acknowledge and agree that you are solely and entirely responsible and accountable for any and all Screen Data that you display on your laptop while AICHI's streaming mode is active. This includes, but is not limited to, personal data, sensitive information, confidential documents, private communications, proprietary business information, or any content that is protected by copyright, privacy laws, or other legal restrictions.
  • No Developer Risk or Liability: You agree that AICHI bears no risk, liability, or responsibility whatsoever for any exposure, breach, misuse, or unintended disclosure of your Screen Data or any information contained therein, regardless of its sensitivity or confidentiality, arising from your decision to activate the Service's streaming capabilities. You indemnify and hold harmless AICHI from any and all claims, damages, losses, or expenses (including legal fees) related to the content you display.
  • Data Handling: While we implement reasonable security measures, you understand that no system is entirely foolproof. For more details on how we collect, use, and store data (excluding the content of your screen which is processed in real-time but not stored by default, unless specified in our Privacy Policy), please refer to our separate Privacy Policy at Privacy Policy.

3.2. Device Security & Unauthorized Access (CRITICAL)

  • User's Sole Responsibility: You acknowledge and agree that the security of your laptop, network, and any associated accounts is your sole and exclusive responsibility. This includes, but is not limited to, maintaining strong passwords, using up-to-date anti-malware software, securing your Wi-Fi, and preventing unauthorized access to your device.
  • No Developer Liability for Hacking: You agree that AICHI bears no risk, liability, or responsibility whatsoever for any unauthorized access to your laptop, or any misuse or compromise of the AICHI Service (including its ability to observe your screen or process data) that results from or is facilitated by a breach in your device's security, malware, or any other form of cyberattack or unauthorized access to your system. You indemnify and hold harmless AICHI from any and all claims, damages, losses, or expenses (including legal fees) related to such security breaches originating from your end.

3.3. Lawful and Ethical Use

  • You agree to use the Service only for lawful purposes and in a manner that does not infringe the rights of, or restrict or inhibit the use and enjoyment of the Service by any third party.
  • You must not use the Service to display, process, or generate content that is illegal, harmful, threatening, abusive, defamatory, obscene, harassing, or racially or ethnically objectionable, or that facilitates illegal activity.

4. DISCLAIMER OF WARRANTIES

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. AICHI makes no representations or warranties of any kind, express or implied, as to the operation of the Service or the information, content, materials, or products included on the Service. You expressly agree that your use of the Service is at your sole risk.

AICHI DOES NOT WARRANT THAT:

  • The Service will function uninterrupted, securely, or be available at any particular time or location.
  • The Service will be free of errors or defects, or that defects will be corrected.
  • The Service will meet your specific needs or expectations.
  • The results obtained from the use of the Service will be accurate or reliable.
  • The Service or its servers are free of viruses or other harmful components.

5. LIMITATION OF LIABILITY

In no event shall AICHI, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

  • Your access to or use of or inability to access or use the Service;
  • Any conduct or content of any third party on the Service;
  • Any content obtained from the Service; and
  • Unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.

6. ARTIFICIAL INTELLIGENCE OUTPUT DISCLAIMER

You acknowledge that AICHI is an artificial intelligence. Its outputs, suggestions, and responses are generated based on algorithms and training data.

  • Not Professional Advice: AICHI's assistance is for informational and educational purposes only and does not constitute professional advice of any kind (e.g., legal, medical, financial, academic certification, or engineering). You should not rely on AICHI's outputs as a substitute for professional advice. Always consult with qualified professionals for specific guidance.
  • Accuracy and Completeness: While we strive for accuracy, AICHI's outputs may not always be accurate, complete, current, or free of errors. You are solely responsible for verifying the accuracy and appropriateness of any information or suggestions provided by AICHI before relying on them.
  • Ethical Considerations: You are responsible for the ethical use of any content or suggestions generated by AICHI.

7. THIRD-PARTY AI PROCESSING AND DISCLAIMER

  • Reliance on Third-Party AI Services: You understand and agree that, in order to provide the core functionality of AICHI (including understanding Screen Data and generating responses to your queries), the Service transmits necessary data (including elements derived from Screen Data and your direct queries) to third-party artificial intelligence and cloud computing providers. This includes, but may not be limited to, services such as Google Cloud and Google Gemini, or other similar providers as we may utilize from time to time.
  • No Control Over Third-Party Practices: While we select our partners carefully and rely on their stated privacy and security commitments, you acknowledge that we have no direct control over how these third-party providers specifically process, store, or otherwise handle the data once it has been transmitted to their systems for the purpose of generating outputs for the Service. Their use of the data is governed by their respective terms of service and privacy policies, to which you are not a direct party.
  • User Assumes Third-Party Risk: By using AICHI, you explicitly acknowledge and assume all risks associated with the transmission of data to, and the processing of data by, these third-party AI and cloud providers. You agree that AICHI bears no responsibility or liability whatsoever for any actions, omissions, data handling practices, breaches, or misuse of data by any third-party AI or cloud computing provider used to power the Service. You further agree to indemnify and hold harmless AICHI from any claims, damages, or losses arising from or related to the conduct of such third-party providers.

8. INTELLECTUAL PROPERTY

The Service and its original content (excluding User-provided Screen Data), features, and functionality are and will remain the exclusive property of AICHI and its licensors. The Service is protected by copyright, trademark, and other laws of both Australia and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of AICHI.

9. LINKS TO OTHER WEBSITES

Our Service may contain links or pass data to third-party web sites or services that are not owned or controlled by AICHI. AICHI has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party web sites or services. You further acknowledge and agree that AICHI shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such web sites or services.

10. TERMINATION

We may terminate or suspend your access immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Service will immediately cease.

11. GOVERNING LAW

These Terms shall be governed and construed in accordance with the laws of Queensland, Australia without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

12. SEVERABILITY

If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Service.

13. CHANGES TO TERMS

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
